Aldon Smith could face NFL punishment after second DUI arrest

Aldon Smith was arrested at 7 a.m. Friday morning on suspicion of DUI after crashing his car in a single-vehicle accident, CSN Bay Area’s Matt Maiocco reported. The Mercury News reported that Smith also had marijuana and pills in the car at the time of his arrest.

Given that this is Smith’s second DUI arrest since the 49ers selected him in the 2011 draft, he could be hearing from the NFL in the near future, especially the possibility of additional drug charges.

Smith’s first alcohol-related legal incident occurred in January 2012, shortly after the 49ers were eliminated from the playoffs. Later during the 2012 offseason, Smith was stabbed at a party in San Jose. Both Smith and former 49ers teammate Delanie Walker were named in a civil suit by someone who was shot during the same party.

Acccording to NBC Bay Area, Ronndale Esporlas, the plaintiff in that suit, “alleged that he suffered ‘serious, catastrophic and permanent injuries’ when he was caught in a ‘crossfire’ of bullets” during the event. Smith’s lawyer responded to the suit just this week, stating that Esporlas “knew of the dangers and risks” of attending the party, per the Mercury News.

All of Smith’s off-field troubles should give the 49ers reason to be concerned — and the NFL is increasingly likely to step in with some discipline of its own following Smith’s latest arrest. Smith has not yet been punished by the NFL for his past transgressions, but a second DUI may put him in line to be hit with a suspension. Such punishment might not occur until the start of the 2014 season, though the 49ers also could choose to step in and deliver a penalty of their own.

Smith, 23, has 37.0 sacks in two-plus seasons for the 49ers and earned his first Pro Bowl and first-team All-Pro nods in 2012. He has 3.5 sacks so far during the 2013 season.

San Francisco takes on Indianapolis on Sunday. Jim Harbaugh said following Friday’s practice (which Smith attended and participated in) that no decision has been made about Smith’s status for Week 3, but that he expects Smith to play.

You idiot's who are placing any blame on Harbaugh and the NFL need to grow up. That is a huge reason why a lot of these athletes make the mistakes they do...because people put the responsibility on others and don't hold the perpetrator accountable. He is a grown man and obviously needs a wake up call but his actions are his alone head coaches can only do so much. Think about your Job, how much is your boss involved in your personal life? Because essentially playing in the NFL is Aldons job and Harbaugh is one of his many bosses. Harbaugh runs a good program, very rarely do you see niners in the news for stuff like this. The blame is On Aldon Smith and him alone!! He will have consequences and hopefully he will start making the right decisions, before worse things come about, and as far as Landry, and Shula do you honestly think their players didn't do stupid stuff off the field? If anything they were probably worse...the difference is it was a totally different era. A different time, different NFL, different media coverage, another world in comparison.

if the NFL lets this slide andhe eventually ends up hurting someone AGAIN with his lack of responsibily I will hold them directly responsible..

if its  a family member of mine or a friend someone I know, I will INSURE the Goodell or the niners coach will NEVER be in the position to make that call ever again..


this is irresponsibility on all levels, apparently football should be X rated television, they just don't get it, either that or they just don't care about public safety and money is all thats on their mind, shame on them

The Niners need to suspend this guy to let him know that his bad behavior off field will not be tolerated. What kind of message are they trying to send to their players? The guys already feel like they're invincible. Its absurd. I'm tired of the excuses and the must win attitude out of San Francisco. Those guys will do anything to win a game, and when they lose its never their fault.

Geez - the guy is obviously in serious trouble - and this is only what gets reported to the cops - what else is he getting away with? NOBODY drives around at 7am on a workday then blows a .15 unless he's a chronic alcoholic. That is not just a night on the town - that is a lifestyle.

@NoQNoSuperBowl For anyone to drive drunk is insane, not just a player, but the issue is really just youth. The issue is NEVER can someone get to where they need to go if they are drunk. If I am drunk (and yes, I have driven while intoxicated in my younger days; so I am not innocent by any means) I either don't go home, pay for a taxi or I get a ride. Just because players get it for free doesn't mean they will utilize the service, just like normal people don't always call taxis or get rides. It doesn't make him insane, it makes him cavalier. He is a young dude who is making mistakes, not unlike most of us in our younger days. He will pay for it from the NFL standpoint, and won't pay for it legally because his attorney will work out a deal, like most Americans who can afford attorneys.
